AP Recruitment Challenge Terms and Conditions

1. The AP Recruitment Challenge (“the Program”) shall run from 1st July 2023 until 31st July 2023 ("the Program Period").
2. The Promotion is applicable only to Avon Puteri ("AP") Assistants who registered during the Program Period ("AP Assistants”). Eligible AP Assistants must maintain good standing throughout the Promotion Period and should not be suspended, cancelled, or terminated by their respective AP.
3. To qualify for the prize, eligible AP Assistants must meet the target requirement for their respective AP Tier during the calendar month of July. The tiering for AP will be attached in Appendix A.
   • AP Tier 1: Receive a 99 Speedmart cash voucher worth RM150.00 per eligible AP Assistant (capped at a maximum of 3 AP Assistants per AP) recruiting at least 75 new representatives, who meet the monthly minimum purchase requirement of RM100.00 net per representative.
   • AP Tier 2: Receive a 99 Speedmart cash voucher worth RM100.00 per eligible AP Assistant (capped at a maximum of 3 AP Assistants per AP) recruiting at least 50 new representatives, who meet the monthly minimum purchase requirement of RM100.00 net per representative. Tier 2 AP Assistants who meet the target requirements for Tier 1 will also be eligible for Tier 1 rewards. Tier 2 AP Assistants will only get one (1) reward which is the higher reward.
   • AP Tier 3: Receive a 99 Speedmart cash voucher worth RM50.00 per eligible AP assistant (capped at a maximum of 3 AP assistants per AP) recruiting at least 25 new representatives, who meet the monthly minimum purchase requirement of RM100.00 net per representative. Tier 3 AP Assistants who meet the target requirements for Tier 1 or Tier 2 can also qualify for the respective rewards. Tier 3 AP Assistants will only get one (1) reward which is the higher reward.
4. If a qualified Representatives makes purchases across multiple APs and/or channels, the bonus will be allocated to the AP or channel with the highest proportion of the Representative's combined purchases.
5. Eligible AP and AP Assistants who fulfill the criteria under Clause 3 will be notified within fourteen (14) days as of the end July, and prizes are to be awarded by the end of the following calendar month (September).
6. The 99 Speedmart cash voucher redemption terms and conditions are as follows:
   • This cash voucher can be redeemed against all products at all 99 Speed Mart’s outlets in Peninsular Malaysia only.
   • This cash voucher can be used together with cash, e-wallet and credit card payment.  
   • This cash voucher validity will be confirmed during the awarding, which is up to the stipulated expiry date and no extension of validity period shall be given.
   • If the value of the products redeemed exceeds the value of the cash voucher, the difference thereof must be borne by the holder. However, if the value of the products redeemed is less than the value of the cash voucher, the difference will not be refunded to the holder.  
   • This cash voucher cannot be exchanged for cash and is non-refundable/non-transferable.
   • Each voucher is valid for one-time redemption only.
7. Eligible AP and AP Assistants will not be eligible for any other Avon recruiter promotions or in combination with any other promotions unless otherwise permitted by Avon in its sole and absolute discretion.
8. Avon reserves the right, in its sole and absolute discretion, to replace the item(s) given with an item of similar value, without having to give any person any notice or reason.
9. Avon may amend or modify these terms and conditions at any time without prior notice, and such changes will be effective immediately upon posting the updated terms and conditions on the Avon website or through other appropriate communication channels.
10. The Company reserves the right to disqualify any AP Assistant in the event the Company solely discovers and/or believes that a Participant:
    • is engaged in unethical, illegal and/or fraudulent conduct or fails to comply with any of the provisions of this Terms and Conditions, the Direct Sales and Anti-Pyramid Scheme Act 1993, the Code of Conduct of the Direct Selling Association Malaysia, or any of the Company’s policies, guidelines or standard operating procedures;
    • makes product returns of products purchased during the Period leading to reduction of the eligibility criteria stated in paragraph 4 of this Terms and Conditions;  
    • has past due account and/or amount due/owing to the Company; and/or
    • whose Independent Sales Representative Agreement with the Company is terminated for whatever reason at the time the winners for the Program is determined.
11. If required to do so, the AP Assistants shall execute all such documentation as deemed necessary by the Company to allow the Company and their assigns to use, display, copy, modify, distribute, publish, sell, assign, exchange, license, sub-license, in any and all locations, in any medium, form or format, in any number, his/her image or likeness or name in any photograph, image, video, motion picture, sound recording and the reproductions thereof, and any biographical information furnished by the AP Assistants to Avon.
12. Participation in the Program constitutes the AP Assistants consent for the Company to use the AP Assistants name and photos for purpose of promotion and marketing.
13. The Company shall not be liable for any loss or damage whatsoever that may be suffered, or for any personal injury that may be suffered, as a result of the AP Assistants participating in the Program and or wining/usage of the Prize.
14. By participating in the Program, the AP Assistants agree with the terms stated in the Company’s Privacy Notice, that his/her personal data collected or provided by/to the Company may be processed, stored, collected, used by the Company, and may be disclosed to third parties including but not limited to the group of companies of the Company, whether within or outside Malaysia for any purpose. In the event a Participant withdraws consent for the processing, collection, storage, use and disclosure of his/her personal data by the Company, the Participant shall notify the Company of his/her intention in writing.
15. The Company excludes and disclaims any representations, warranties and/or guarantees, whether expressed or implied, written or oral, including but not limited to, any guarantees on the quality and/or merchantability for a specific purpose of the products sold by the Company.
16. The AP Assistant agrees to waive any rights he/she may have against the Company, its directors, shareholders, officers, employees, representatives and/or its agent in respect of any loss or damages that may arise in any way whatsoever in connection with the Program.   
17. By participating in the Program, the AP Assistant unconditionally agrees to be bound by this Terms and Conditions (which may be amended from time to time and therefore the AP Assistant’s continued participation in the Program will constitute the AP Assistants acceptance of such changes.), the Company’s Privacy Notice and the Company’s decision of the Winners.
